Terms and Conditions

1. About MatesLend

1.1. MatesLend is:

(a) An online platform that enables Owners of Goods to create listings for leasing purposes, connecting them with Users of the MatesLend online platform. MatesLend acts as a facilitator in bringing Owners and Users together.
 

1.2. Under this arrangement, MatesLend:

(a) Provides Owners the ability to showcase and market their Goods on the platform for a Fee;

(b) Acts as an intermediary for transactions between Owners and Users, without being a party to the Lease;

(c) Is not an insurer, property manager, or broker of any kind.

 

1.3. By using the MatesLend online platform:

(a) you acknowledge entering into a binding agreement with MatesLend,  encompassing these Terms and Conditions, Privacy Policy, and any other terms, documents, or policies provided by MatesLend, collectively referred to as the 'Agreement.

 

1.4. MatesLend reserves the right to:

(a) modify the Agreement at any time, with notice given through email or platform postings.

(b) advised users to regularly review the agreement on the MatesLend platform.

 

1.5. If you disagree with the Agreement, refrain from using MatesLend.

 

2. Contractual Relationship

 

2.1. Terms Governing this Agreement

(a) MatesLend will engage with users by these Terms and Conditions.

 

2.2. Previous Agreement

(a) These Terms and Conditions supersede all previous agreements between parties, replacing any prior verbal, written, or other agreements.

 

2.3. Relationship of Parties

(a) Users declare themselves as independent contractors, not employees or general agents of MatesLend.

 

3. Account Users and Member Profiles

 

3.1. Account Registration

(a) To use MatesLend, users must register an account, including an email address and password (Account). Users are responsible for their Account's confidentiality.

(b) Users must notify MatesLend of any unauthorized Account use.

(c) Registration confirms providing accurate, current, and complete information. Users are accountable for maintaining this information.

(d) MatesLend may suspend or terminate Accounts with inaccurate or incomplete information.

 

3.2. Member Profiles

(a) MatesLend creates an account Profile based on user-provided information, accessible on the website.

(b) Users are responsible for the accuracy of their Account Profile.

(c) Users grant MatesLend a license to use any intellectual property (Materials) provided in their Account Profile.

(d) Users must be over 18 years old to create an Account Profile.

 

3.3. Account User Behavior

(a) MatesLend monitors and reserves the right to cancel Accounts for misconduct, fraud, inappropriate conduct, or poor user experience.

 

4. Listing Your Goods on MatesLend

4.1. MatesLend makes Listings available upon registration, allowing users to lease Goods based on the provided information.

 

4.2. Listings require:

(a) Detailed Good description, condition, and defects;

(b) Specifications, including registration details;

(c) Specific leasing conditions;

(d) Photographs;

(e) Listing Price;

(f) Availability;

(g) Bond Amount.

 

4.3. Listing Requirements must be accurate, complete, and up-to-date. Users are responsible for regular reviews.

 

4.4. Users are responsible for their pricing decisions, information in Listings, and maintaining high standards.

 

4.5. Separate Listings are required for each Good.

 

4.6. Unavailable Goods must have Listings removed or suspended promptly.

 

4.7. Users determine the Listing Price and Bond Amount, with Bonds held by MatesLend.

 

5. Bond Amount

 

5.1. Bond

(a) MatesLend offers the option for Owners to receive a Bond.

(b) The Bond is held in escrow and released to the Owner upon confirmation of Good condition.

 

5.2. Amount of Bond

(a) MatesLend does not determine the Bond value and is not responsible for shortfalls covering damage.

 

5.3. Release of Bond

(a) MatesLend releases the Bond to the User upon the Owner's instruction.

(b) Disputes are resolved with MatesLend acting as an intermediary, requesting relevant documentation for dispute resolution.

(c) MatesLend notifies parties if unable to assist in dispute resolution. mate each one a little longer

 

6. Lease Agreement

6.1. Acceptance of Lease

(a) Users agree to the terms outlined in the Lease Agreement when leasing Goods through MatesLend.

(b) Users are responsible for reviewing and understanding the Lease Agreement terms before proceeding with any transaction.

6.2. Lease Duration and Renewal

(a) Lease durations are agreed upon by Owners and Users.

(b) Owners may offer lease renewals at their discretion.

​

6.3. Payment and Fees

(a) Users agree to pay the Listing Price and any applicable fees through the MatesLend platform.

(b) MatesLend charges a service fee, which is a percentage of the Listing Price.

​

6.4. Cancellations and Refunds

(a) Owners and Users must adhere to the cancellation policy outlined in the Lease Agreement.

(b) Refunds are subject to the terms specified in the cancellation policy.

​

6.5. Insurance

(a) Owners are responsible for providing insurance for their Goods during the lease period.

(b) MatesLend does not offer insurance coverage and is not liable for any damage or loss.

(c) Owners are advised to check the conditions of their insurance policy before listing an item on Mateslend

 

7. Reviews and Ratings
​

7.1. User Feedback

(a) Users may leave reviews and ratings for each other based on their leasing experience.

(b) MatesLend encourages honest and constructive feedback to maintain a trustworthy community.

​

7.2. Dispute Resolution

(a) Users must attempt to resolve disputes amicably.

(b) MatesLend may act as a mediator in disputes but is not obligated to provide a resolution.

8. Termination of Agreement
​

8.1. Account Termination

(a) MatesLend reserves the right to suspend or terminate user accounts for violations of the Agreement, misconduct, or any other reasons at its discretion.

8.2. Effect of Termination

(a) Termination does not release users from any obligations incurred before termination.

 

9. Limitation of Liability

​

9.1. MatesLend's Liability

(a) MatesLend is not liable for any direct, indirect, incidental, consequential, or punitive damages arising from the use of the platform.

​

9.2. Indemnification

(a) Users agree to indemnify and hold MatesLend harmless from any claims, losses, or liabilities arising from their use of the platform.

10. Governing Law and Jurisdiction
​

10.1.  Applicable Law

(a) The Agreement is governed by the laws of [Jurisdiction], without regard to its conflict of laws principles.

​

10.2. Dispute Resolution

(a) Any disputes arising from the Agreement will be resolved through arbitration by the user's state's arbitration legislation.

11. Identification and Verification

​

11.1. GreenID Verification

(a) MatesLend offers the GreenID verification service free of charge to users to verify their identity.

(b) Users are required to complete the GreenID verification process to list or rent a product on the MatesLend platform.

(c) The GreenID verification process may include but is not limited to, identity document verification, facial recognition, and other identity authentication methods.

11.2. User Responsibility

(a) Users acknowledge and agree that providing accurate and truthful information during the GreenID verification process is essential.

(b) MatesLend reserves the right to suspend or terminate user accounts that fail to complete the GreenID verification or provide false information.

​

11.3. License Verification

(a) If a product listed on MatesLend requires a license to be legally operated in a particular state, it is the responsibility of the Owner to verify and ensure the validity of the required license.

(b) Owners must confirm that the renter possesses the necessary license before agreeing to the lease transaction.

​

11.4. Failure to Verify License

(a) MatesLend is not responsible for verifying the validity of licenses required for specific products.

(b) Owners acknowledge that failure to correctly ascertain the validity of a license and any damages incurred as a result are the sole responsibility of the Owner, not MatesLend.

​

11.5. Reporting Invalid Licenses

(a) Users are encouraged to report any instances of invalid licenses to MatesLend promptly.

(b) MatesLend may take appropriate action, including suspension or termination of accounts, in response to reports of invalid licenses.

​

11.6. Liability for Damages

(a) Owners are solely responsible for any damages or losses incurred as a result of leasing a product to a user with a valid, invalid or fraudulent license, this is because:

(b) Listers create a bond amount to cover any damages and or use of insurance claims at their own discretion. Mateslend can advise a bond amount but ultimately has no control over the set bond amount.

(c) MatesLend assumes no liability for damages resulting from the failure to verify licenses.
 

11.7. Compliance with Local Laws

(a) Users are expected to comply with all local laws and regulations regarding the use and licensing requirements for products listed on MatesLend.

11.8. Verification Process Updates

(a) MatesLend reserves the right to update or modify the GreenID verification process and related identification requirements.

(b) Users will be notified of any changes to the identification verification process through the platform or email.

​

12. Miscellaneous
​

12.1. Entire Agreement

(a) The Agreement constitutes the entire understanding between users and MatesLend, superseding any prior agreements or understandings.

​

12.2. Waiver

(a) MatesLend's failure to enforce any provision of the Agreement does not waive its right to enforce that provision in the future.

12.3. Contact Information

(a) Users agree to receive communications from MatesLend through email or platform notifications.

​

By using the MatesLend online platform, users agree to abide by these Terms and Conditions and the entire Agreement outlined herein.
